Could anyone please tell me what this plant maybe and when to cut it back as I would like to do it now but worried the frost will kill it??

is this a current photo or has it dropped its leaves?
if you want to reduce it severely do a third this spring then another 1/3 the next and again the nextyear. I cant make out the tree from the photo sorry.
