Its a yellow rumped warbler unless I'm mistaken.

It's much more difficult to photograph birds than flowers! I had to put my camera on sport mode to get a decent shot of them. Since I haven't a clue about birds... I'm going to go with Gilli and call it a Yellow Rumped Warbler. Pink Floyd said that it was a finch, I think... I think that finches have a more of a acorn shaped beak and this little guy has a tiny tweezer beak.
