How to safely kill off a small tree?

The tree has its roots firmly in the foundations of my house. It has been there since we moved in 10 years ago but im concerned it may become a problem. Im not a gardener myself and have no idea what species it is, although it only grows to about shoulder height.

Cut it down to a stump 1ft. high, drill holes in the top, fill with neat SBK, plug holes with putty.

Follow the root and dig it out. Fill holes after with 3:1 concrete. The root itself is not the biggest problem - its moisture following it in to your concrete, freezing and expanding the gap!
