Badgers do dig toilet holes but that's very deep!
Have a look round the edges of the garden to see if you can find somewhere an animal might be getting in, and if so look for footprints. Badger prints are rather round and broad, foxes are narrower and more dog like.

Could it be a rabbit digging the holes and then a fox coming along after and pooing? I say this because the little so and so's get into a friend's garden on a farm and they dig holes everywhere.

Badgers make a lot of mess outside the hole as they bring out their bedding
