Can any one ID these two plants for me, not sure if the small one is a weed!

Actually, to me it looks like a Trachelospermum with mild frost damage.

Definitely not Aucuba, leaves are way too small Stera, sorry - more likely its Trachelospermum jasminoides...

I have just looked at the Trachelospermum on the web and it does look very similar, the leaves to the plant in my garden are defiantly variegated and not damaged, there are no flower buds forming. We moved in to this house in November but came to see it at the beginning of September, I don't remember it been flower.
Thank you for taking the time to reply and I will keep you posted if it does come into flower.

Actually, Derek, Elaeagnus has alternate foliage, rather than opposite, as this plant has.
Mehas, were the leaves spotted like this last September? If the pale areas aren't sunken, it might be a mild zinc deficiency.

Agree with Tugbrethil - the variegated version of Trachelospermum does not look like this, the variegation being more creamy white, so I would say the yellow markings on the leaves do indicate a deficiency of some sort - but I wasn't sure what...

Unfortunately I really. Didn't take much notice of the plant just remember it was not in flower. Thanks for the answers I'm sure I will find the name one day!

If it is Trachelospermum, ours here are just coming into bloom, so it may be another month or two before yours does. Watch for small, branching sprouts coming from the joints of last year's growth!

I think the second one is "spotty laurel", Aucuba japonica.
