i have a tree that is growing and blocking the light considerably at the top of my garden and the roots are destroying my fence it is on a patch of land that no one is accepting responsibility for what can i do?

Contact the council they may know who owns the land? You are on dodgy ground if you touch it first without checking if its protected or if the site is not abandoned.

If it's not protected by a Tree Preservation Order you'd be able to prune off branches on your side of the fence. You'd need to check first with the Council to see if there's a TPO on it.
