I have a Magnolia in a pot which is about 4ft tall which is still in leaf, we want to move it to a larger pot, can I do it now or should I wait,

I'd wait till late winter/early spring and do it then, while its still relatively dormant. But your magnolia won't appreciate it whenever you do it, frankly, they hate root disturbance, which is why they don't make good subjects for containers.
