Update on Open Reach and the line going across our garden.

Hi all,
just thought I would give you an update on our fight with Open Reach and them hanging a new phone line across the corner of our garden and putting the cherry bucket over the hedge into our garden without even knocking on the door to tell us about it 1st.
In the photo there is a Western Power pole in next doors garden but the new phone line wasn’t run to this like the old line but just above one of our plum trees. It’s hard to see but the blue arrows show the new line.
We found the email address of the CEO of Open Reach and sent in a complaint. Their reply was more or less tough. That they were sorry the engineers didn’t inform us before putting the cherry picker bucket into our garden but technically they didn’t have to as Open Reach have an act of parliament giving them the right to the air space above our gardens and the reason they didn’t attach the new line to the pole there was that Western Power had stamped it with a red D meaning that it was no longer safe to use. They did then add that if we wanted to pay for a new pole in our neighbour’s garden then they would move the new line to go to the new pole.
Tim wasn’t giving up there, we took photos (better ones then the above one ?) showing how close the new line was to our plum tree and said that it was a danger to us and the line when it comes to pruning the tree.
This morning I was planting a clematis to grow up the trellis in the corner when a Western Power van went up next doors drive. He then came back down and stopped the van by me, asking if I knew when next door would be home as Western Power were going to replace the pole and he needed to talk to them. He gave me his contact details and ask me to pass them on to my neighbours which I did, I texted them to them right there and then lol.
This afternoon I then received a phone call from Open Reach to say that the pole was being replaced and once done, the new phone line would be moved!!!!!!!!! He stressed that normally Open Reach would not do this but in our case they will make an exception. He then followed this up with a confirmation email. So, the long and short of it, WE WON!!!!
Oh and he also agreed that it was not best practice to have put a cherry picker bucket into our garden without warning us 1st and that he will be talking to the area manager, telling him that his engineers must always inform people 1st ?.
So that’s my update ?. Just goes to show that sometimes you can win when going up against the big company’s ?

Three cheers for you! Can you please sort out my Car insurance? ;) I nearly broke down in tears today on the phone...my fourth attempt to sort an issue..four times on the same number waiting and listening to all their lengthy recorded blurb, and waiting in the queue... only to get through and then get cut off...twice. Still not sorted.

I think Sue, where it's a plum tree, they could kill if pruned the wrong time of year maybe. The bloke who installed it didn't seemed bothered about any of the trees. In fact they hung the line on one of the branches of another tree and it loops up.
Oh poor you Karen. I hate phoning companies like that. Don't know if there is an email address that you can contact, put in a complaint and maybe ask them to phone you. Good luck ?

Thank you Hywel. Tim just wouldn't take no without a fight lol. Took about 8 emails. The 1st reply was from someone lower in the company with the tough reply, so he went back to the top. The phone call yesterday was from the guy in charge of all insulations for the whole of UK lol. He has given us all his contract information so that if there are any more problems we can contact him. His email says that the pole will be changed by the end of the week and then the phone line moved by the end of next week. To be honest, I didn't think we stood a chance but Tim just wouldn't give up.

Jen I wasn't suggesting they cut the branches off! I meant that they are usually careful to avoid branches touching their lines so it seems an odd thing to do to actually route them through a tree to begin with! Sounds to me as though the operatives were incompetent.
Good for Tim - sometimes going to the top is the only answer.

Lol, sue. Think you could be right. When we tried to speak to them, they didn't seem the brightest tack in the box. They put it through 3 trees and above ours. At one stage I saw him bouncing the line trying to free it from one of the trees but then he gave up so the looping up that I said about, laying on a branch next to the trunk. It was one of our customers who gave us the idea to email the CEO. I phoned him up this morning to thank him.

Thank you Lisam. We have had a slight set back. Had a phone call from our guy at Open Reach to ask if I had any contact details for next door. They didn't phone Western Power even though they told me they would and haven't replied to any of their letters. Pole on their property so Open Reach and Western Power need their permission to carry out the work. I'm just hoping they want an unsafe pole removed and it replaced by a safe one.

That must make you both very happy! Its odd that they put the line so near the tree in the first place - when the trees on our boundary have branches very near the lines Open Reach send man in van to cut the offending branches off!
